Refunds Policy
MindCentered Psychiatry. Please review these terms carefully — booking a session constitutes acceptance of this agreement.
1. PURCHASE AND REFUNDS
1.1. Professional Services: MindCentered Psychiatry and ADHD does not offer refunds for professional clinical services rendered. All contracts and purchases for evaluations and follow-up care are binding.
1.2. Outcome-Based Refunds: We do not offer refunds based on the clinical outcome of an evaluation. The purchase of an evaluation is for the provider’s professional time and expertise. Completion of an evaluation does not guarantee a specific diagnosis or the prescription of any medication (including controlled substances).
1.3. Digital & Info Products: Due to the nature of downloadable infoproducts and digital materials being accessible at the time of purchase, we do not offer refunds or cancellations for these items. All such purchases are binding.
1.4. Sole Discretion: Any refunds or fee waivers outside of the technical failure of the provider are at the sole and absolute discretion of MindCentered Psychiatry and ADHD. These are evaluated on a case-by-case basis but are generally strictly enforced as non-refundable.
2. APPLICATION OF TERMS
2.1. These terms and conditions apply to all clinical programs, evaluations, and telehealth services operated by MindCentered Psychiatry and ADHD. By registering as a patient or purchasing a program, you agree to these Terms, which prevail over any inconsistent terms implied by law or trade custom.
2.2. The agreement between the practice (“we”, “us”) and the patient (“you”) comes into effect upon our email confirmation of your appointment or registration and continues until clinical services are concluded or terminated in accordance with these Terms.
3. TELEHEALTH & CLINICAL SESSIONS
3.1. Jurisdictional Requirement: You must be physically located in Florida or California at the time of your telehealth session. Misrepresentation of your location is a breach of this contract and may result in immediate termination of the session without a refund.
3.2. Cancellation & Rescheduling:
- 48-Hour Notice: We require a minimum of 48 hours’ notice to cancel or reschedule an appointment.
- Annual Grace Period: Each patient is permitted one (1) late cancellation grace period per calendar year. This allows for one instance of rescheduling with less than 48 hours’ notice without penalty.
- Late Fees: After the one-time grace period is exhausted, any session canceled with less than 48 hours’ notice will be charged the full amount of the scheduled service.
3.3. No-Show Policy: If you fail to arrive for your telehealth session within 10 minutes of the scheduled start time, it is considered a “No-Show.” No-shows are charged the full amount of the service. The annual grace period does not apply to no-shows.
3.4. Technical Failures: If a session cannot be completed due to a technical failure on the provider’s end, a full refund or no-cost reschedule will be issued. If the failure is on the patient’s end, the full fee applies, though the provider may attempt to complete the visit via telephone if clinically appropriate.
4. PAYMENT
4.1. Direct-Pay Model: MindCentered Psychiatry and ADHD is a direct-pay practice. We do not accept insurance. You are responsible for the total price payable at the time of scheduling.
4.2. Instalments: If a program is purchased via instalments, you are obligated to complete all payments regardless of whether you complete the program or choose to terminate services early.
5. PRIVACY & HIPAA
5.1. Confidentiality: We comply with HIPAA regulations regarding your Protected Health Information (PHI). Your data is processed and stored on secure, HIPAA-compliant servers.
5.2. Limits of Confidentiality: We reserve the right to disclose information in absolute discretion if necessary to prevent illegal acts or harm to yourself or others, as required by law.
6. LIABILITY & RESULTS
6.1. No Guarantees: Due to the complex nature of psychiatric care and ADHD treatment, we do not guarantee specific clinical results. Success is dependent on various factors, including patient adherence to treatment plans.
6.2. Limitation of Liability: Our total liability in connection with the performance of this contract shall be limited to the price paid by you for the specific service or program in question.
7. GOVERNING LAW
7.1. This Contract and any dispute arising from it shall be governed by and construed in accordance with the laws of the State of Florida and the State of California, depending on where the service was rendered.
7.2. You irrevocably agree that the courts within the aforementioned states shall have exclusive jurisdiction to settle any dispute or claim arising out of this Contract.
