1. Purchase and Refunds
1.1. Mind Centered Psychiatry does not offer refunds or cancellations for scheduled EMDR therapy programs or sessions. All contracts and purchases are binding.
1.2. Because our EMDR therapy programs involve professional time allocation, clinical resources, and proprietary therapeutic protocols, we do not offer refunds or cancellations once the registration is confirmed.
1.3. We stand by the clinical quality of our EMDR therapy services. If for any reason you feel the standards of care have not been met, please email us at info@mindcenteredpsychiatry.com.
2. Application of Terms and Conditions
2.1. These terms and conditions (“Terms”) apply to the Mind Centered Psychiatry EMDR Therapy Program (“Program”) operated by Mind Centered Psychiatry. By registering to be a participant in our Program, you agree to the following Terms and that these prevail over any inconsistent terms or conditions contained, or referred to, elsewhere or as implied by law, trade custom, practice or course of dealing.
2.2. The agreement between us and you, the person or entity registering to be a participant in the Program (“you”) and which is subject to these Terms (“Contract”), shall come into effect upon us emailing you to confirm our acceptance of your registration form for the Program and shall continue until terminated in accordance with these Terms.
2.3. If you are purchasing online, the order process will be as follows:
- 2.3.1. Add the Program to the cart and proceed to the checkout and make payment as directed;
- 2.3.2. We will send you an email acknowledging your order and confirming whether we have accepted your order.
- 2.3.3. If at any stage you have made an error in your order, you may email us at info@mindcenteredpsychiatry.com to correct any errors.
3. The Program
3.1. The Program will be provided over the course specified on the sales page and shall be delivered by a combination of online sessions, telephone sessions, or one-on-one in-person sessions (“In-Person Session”).
3.2. The date and time of all sessions are subject to clinician availability. While we provide as much notice as possible for changes, Mind Centered Psychiatry shall not be liable for any losses resulting from rescheduled sessions.
3.3. Cancellation and Rescheduling:
- Standard Sessions: If you need to cancel an In-Person Session, you should provide us with as much notice as possible.
- 3-Day Retreat Intensive: The 3-day portion of the retreat requires a minimum of 48 hours’ notice for cancellation.
- Rescheduling Limit: The retreat portion may only be rescheduled one (1) time. Any rescheduling is at the sole discretion of Mind Centered Psychiatry.
- Late Notice: If you provide less than 48 hours’ notice for the retreat (or less than 24 hours’ notice for standard sessions) or fail to provide any notice, we may not be able to reschedule the session and shall not be obliged to refund any amounts paid.
4. Payment
4.1. The total price payable for the Program is as set out in the summary of key terms and on the shopping carts provided.
4.2. Deposits: A 50% deposit is required upon registration for the Program. This deposit is strictly non-refundable.
4.3. Payment in Full: While payment in full is requested at the time of registration, the remaining balance must be paid in full within 2 weeks (14 days) of the initial deposit.
4.4. Payment is to be made by any method that is detailed on our site from time to time.
4.5. Without prejudice to any other right or remedy that we may have, if any sum payable under these terms is not paid within the required timeframe, we reserve the right to (i) charge interest at the rate of 3% above the base rate and/or (ii) suspend the availability of the Program or cancel your registration while retaining the non-refundable deposit.
5. Intellectual Property
5.1. Mind Centered Psychiatry is the owner or the licensee of all Intellectual Property Rights in the Program and all content within the Program. Nothing in these Terms shall operate to transfer ownership to you.
5.2. You may not at any time copy, reproduce, publish in any form, share, sell, or otherwise make available to a third party any of the content or materials contained in the Program.
5.3. We grant to you a limited, non-exclusive, non-transferable revocable licence to use the content of the Program for your personal therapeutic purposes only.
6. Liability, Governing Law, Confidentiality and Data
6.1. We warrant that the Program and materials are of satisfactory quality. However, due to the nature of therapy and the fact that success is dependent on factors over which we have no control, we do not guarantee any particular clinical results.
6.2. Our total liability in contract, tort, or otherwise arising in connection with the performance of this Contract shall be limited to the price paid by you for the Program.
6.3. The Contract and any dispute arising out of it shall be governed by and construed in accordance with the laws of the State of Florida.
6.4. We acknowledge that in the course of the Program we will have access to your confidential information. We agree not to (except in the proper course of our duties) use or disclose to any third party such confidential information. This restriction does not apply to:
- (a) Any use or disclosure authorized by you or required by law (including HIPAA compliance and mandatory reporting);
- (b) Any use or disclosure which we in our absolute discretion consider necessary or advisable in order to prevent illegal acts or harm to you or to others;
- (c) Any information which is already in the public domain.
6.5. You acknowledge and agree that your personal data will be processed by and on behalf of Mind Centered Psychiatry as part of providing the Program to you.
7. Intellectual Property
7.1. Mind Centered Psychiatry is the owner or the licensee of all Intellectual Property Rights in the Program and all content within the Program. Nothing in these Terms shall operate to transfer ownership of these rights to you.
7.2. You may not at any time copy, reproduce, publish, share, sell, or otherwise make available to a third party any of the therapeutic content or materials contained in the Program.
7.3. We grant to you a limited, non-exclusive, non-transferable, revocable license to use the Program content for your personal, non-commercial therapeutic purposes only.
7.4. Use of our logo or brand name is strictly prohibited without our prior written consent.
7.5. You may not, without our prior written consent, make any audio or visual recordings of any part of our Program or sessions.
7.6. The provisions of this paragraph 7 shall survive termination of the Contract.
8. Term and Termination
8.1. The Contract shall continue until the end of the Program unless terminated earlier in accordance with these Terms.
8.2. Either party may terminate the Contract on written notice if the other commits a serious breach of these Terms, becomes insolvent, or acts in a manner that brings the other party into disrepute.
8.3. Upon termination, you shall immediately pay any unpaid fees or remaining balances. For the avoidance of doubt, the 50% deposit remains non-refundable and the full balance is due if termination occurs within the program window.
8.4. Termination shall not affect accrued rights, remedies, or liabilities existing at the date of termination.
9. Liability
9.1. Nothing in this paragraph 9 shall limit our liability for death or personal injury caused by our negligence or for fraud.
9.2. Mind Centered Psychiatry shall not be liable for any loss of profits, business, or indirect/consequential loss arising out of your participation in the Program.
9.3. Our total liability in connection with the performance of this Contract shall in all circumstances be limited to the total price paid by you for the Program.
9.4. We shall not be liable for changes in the Program location, session times, or specific clinicians/facilitators, provided reasonable notice is given where possible.
10. General
10.1. By registering, you warrant that you are at least 18 years old and legally capable of entering into binding contracts.
10.2. Communication will be primarily electronic via info@mindcenteredpsychiatry.com. You agree that all electronic contracts and notices satisfy any legal requirement that such communications be in writing.
10.3. We may vary these Terms (except for the price already paid) from time to time. Continued participation in the Program constitutes acceptance of new Terms.
10.4. This Contract is personal to you and may not be assigned to any other person.
10.5. If any part of these Terms is deemed unenforceable by a court, the remaining provisions will continue to be valid.
10.6. Governing Law: The Contract and any dispute arising out of it shall be governed by and construed in accordance with the laws of the State of Florida.
10.7. Jurisdiction: We each irrevocably agree that the State of Florida shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this Contract.
