Terms of Service & Privacy Policy
MindCentered Psychiatry. Please review these terms carefully — booking a session constitutes acceptance of this agreement.
1. CLINICAL SERVICES & REFUND POLICY
1.1. Professional Services: All clinical services, including initial ADHD evaluations and follow-up care, are professional services rendered for the provider’s time and expertise. All purchases are binding.
1.2. Outcome-Based Refunds: We do not offer refunds based on the clinical outcome of an evaluation. The completion of an evaluation does not guarantee a specific diagnosis or the prescription of any medication (including controlled substances). Treatment plans are at the sole clinical discretion of the provider.
1.3. Refund Discretion: Any refunds or fee waivers—outside of a documented technical failure on the provider’s end—are at the sole and absolute discretion of the practice. Requests are evaluated on a case-by-case basis but are generally strictly enforced as non-refundable.
2. TELEHEALTH JURISDICTION & REQUIREMENTS
2.1. Physical Location: Due to medical licensing laws, you must be physically located in the State of Florida or the State of California at the time of your telehealth session. Misrepresentation of your location is a breach of this agreement and may result in the immediate termination of the session without a refund.
2.2. Technology Requirements: Patients are responsible for ensuring a private environment and a stable internet connection. If a session is interrupted by a patient-side technical failure, the provider will attempt to complete the visit via telephone; if this is not possible, the session is treated as a late cancellation.
3. CANCELLATION, NO-SHOW, & LATE POLICIES
3.1. The 48-Hour Rule: We require a minimum of 48 hours’ notice to cancel or reschedule an appointment.
3.2. Annual Grace Period: Each patient is permitted one (1) late cancellation grace period per calendar year. This allows for a one-time rescheduling with less than 48 hours’ notice without penalty.
3.3. Late Cancellation & No-Show Fees:
- After the one-time grace period is exhausted, any session canceled or rescheduled with less than 48 hours’ notice will be charged the full amount of the scheduled service.
- A “No-Show” is defined as being more than 10 minutes late to the virtual waiting room. No-shows are charged the full amount of the service. The annual grace period does not apply to no-shows.
4. PAYMENT & FINANCIAL RESPONSIBILITY
4.1. Direct-Pay Practice: MindCentered Psychiatry and ADHD is a direct-pay practice and does not accept insurance as a form of payment. You are responsible for the full payment at the time of scheduling.
4.2. Payment Binding: By booking, you agree to pay the total fee for the professional time reserved. If you have entered into a multi-session program or installment plan, you are obligated to complete all payments regardless of early termination.
5. PRIVACY & HIPAA COMPLIANCE
5.1. Protected Health Information (PHI): We comply with the Health Insurance Portability and Accountability Act (HIPAA). Your medical records and personal data are stored on secure, encrypted, HIPAA-compliant servers.
5.2. Confidentiality Limits: We maintain strict confidentiality except where required by law or in cases where disclosure is necessary to prevent imminent harm to yourself or others.
6. LIABILITY & CLINICAL OUTCOMES
6.1. No Guarantees: Due to the nature of psychiatric care, we do not guarantee specific results. Patient outcomes depend on various factors, including clinical history and adherence to treatment protocols.
6.2. Limitation of Liability: Our total liability in connection with the performance of this contract shall be limited to the price paid by you for the specific service in question.
7. GOVERNING LAW
7.1. Jurisdiction: This agreement is governed by the laws of the State of Florida and the State of California. Any legal disputes shall be settled exclusively within the jurisdiction of the state where the service was rendered.
